1. Nature of Service
This service is a limited, non-invasive, visual property condition checkup intended to identify observable maintenance issues, visible signs of damage, and conditions that may contribute to future property damage, repair costs, or potential insurance claims. This service is not a real estate transaction inspection, municipal code inspection, engineering analysis, environmental assessment, or certification of the present or future condition of the property.
2. Independent Service / No Incorporation into Construction or Repair Contracts
This property condition checkup service is a standalone, limited-scope evaluation and is separate from any repair, remediation, restoration, or home improvement services that may be performed by PURO-TEC under a separate agreement.
This property condition checkup is not part of, and shall not be incorporated into, any home improvement contract, repair contract, or scope of work unless expressly stated in a separate written agreement signed by both parties.
The customer agrees that this property condition checkup shall not be relied upon to define, expand, limit, or interpret the scope, pricing, or performance of any subsequent repair, remediation, or construction services.
3. Visual and Non-Destructive Only
The property condition checkup is strictly visual and limited to areas reasonably accessible at the time of service. No destructive testing, dismantling, disassembly, opening of walls, ceilings, floors, roofs, or other concealed areas, or moving of personal property will be performed unless separately agreed to in writing.
4. Limited Scope / Accessible Areas Only
PURO-TEC is not responsible for identifying conditions that are hidden, latent, intermittent, seasonal, obstructed, unsafe, inaccessible, underground, inside walls or other concealed spaces, or otherwise not reasonably visible at the time of the property condition checkup.
The property condition checkup represents a limited snapshot in time, and conditions may change after the service.
5. No Guarantee or Warranty
PURO-TEC makes no guarantee, representation, or warranty, express or implied, that all defects, deficiencies, mold conditions, leaks, failures, hazards, or future problems will be identified during the property condition checkup.
The property condition checkup is not exhaustive and reflects only visible conditions at the time of service. Conditions may exist that are not identified during the service and may become apparent later, including during repair, demolition, or normal use of the property.
Any observations, comments, or recommendations are provided for general informational purposes only and do not constitute a warranty, certification, or prediction of future performance or condition.
6. No Reliance for Repair, Construction, or Insurance Decisions
The customer acknowledges that this property condition checkup is limited in scope and agrees not to rely on this property condition checkup, or any observations, comments, or recommendations, as a complete representation of existing conditions for purposes of repair, construction, remediation, insurance claims, or property valuation.
Any repair or construction work must be based on separate evaluation, scope development, and written agreements.
7. Not a Scope of Work or Project Specification
This property condition checkup, and any related notes, communications, or optional reports, do not constitute a scope of work, construction specification, or project plan.
Any future work must be defined in a separate written agreement.
8. Purpose of Service
The purpose of this property condition checkup is to help the customer identify visible conditions and potential concerns so they may better understand the property, plan maintenance, and reduce the risk of future damage, repair costs, or insurance-related losses.
This property condition checkup does not eliminate risk or predict future events, failures, or claims.
9. Recommendations and Further Evaluation
PURO-TEC may recommend monitoring, maintenance, repair, remediation, or further evaluation by qualified specialists. The customer acknowledges that specialist evaluation may be required for roofing, plumbing, electrical, HVAC, structural, environmental, drainage, mold, or other systems beyond the scope of this property condition checkup.
10. Conditions Discovered During Repairs
The customer acknowledges that additional or different conditions may be discovered during repair, demolition, or remediation activities that were not visible or detectable during this property condition checkup.
PURO-TEC shall not be responsible for identifying such conditions during this property condition checkup, and any such conditions may require separate evaluation, additional work, and additional cost under a separate agreement.
11. Estimates for Additional Work
If requested, PURO-TEC may provide a written estimate for repair, remediation, or related services. Any such work will require a separate written agreement and is not included in the property condition checkup service.
12. Optional Written Report
A written report is not included unless specifically requested. If requested, a written report can be provided for an additional fee of $305.00.
13. Mold / Moisture Limitations
Mold, moisture intrusion, humidity conditions, and microbial growth are inherently variable and may not be detectable during a visual property condition checkup.
PURO-TEC makes no representation or warranty regarding the presence, absence, type, source, spread, or future development of mold or microbial growth.
14. Mold Sampling and Testing
If requested, surface swab sampling may be performed for an additional fee of $25.00 per sample. Air sampling, laboratory analysis, or environmental testing are not included unless separately agreed to in writing.
15. No Insurance Coverage Representation
This property condition checkup does not determine insurance coverage, claim validity, or scope of loss. Any observations or opinions are not intended to be relied upon by insurers or for claim settlement purposes.
16. Scheduling and Payment
Property condition checkup requests are processed only after payment is completed and verified. Submission of a request does not guarantee an appointment. Scheduling is subject to availability and confirmation by PURO-TEC.
17. Customer Responsibilities
The customer is responsible for providing accurate information and ensuring safe and reasonable access to the property. PURO-TEC may limit, postpone, or decline property condition checkup activities where access is restricted or conditions are unsafe.
18. No Third-Party Reliance
This property condition checkup is provided solely for the customer’s use. No third party, including buyers, sellers, insurers, contractors, agents, or tenants, may rely on the property condition checkup or any related materials without prior written consent from PURO-TEC.
19. Limitation of Liability
To the fullest extent permitted by law, PURO-TEC’s total liability for any and all claims arising out of or related to this property condition checkup service shall be limited to the amount paid for the service.
PURO-TEC shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to future property damage, loss of value, lost opportunity, business interruption, relocation costs, or insurance-related losses.
20. Time Limit for Claims
Any claim arising out of or relating to this property condition checkup must be submitted in writing within a reasonable time after discovery and no later than one (1) year from the date of service, to the fullest extent permitted by law.
21. Venue and Dispute Resolution
Any dispute arising from this property condition checkup shall be brought exclusively in a court of competent jurisdiction located in the county and state where PURO-TEC principally operates, unless otherwise agreed in writing.
22. Severability
If any provision of these Terms and Conditions is found unenforceable, the remaining provisions shall remain in full force and effect.
23. Acceptance
By proceeding with payment or accepting the property condition checkup service, the customer confirms that they have read, understood, and agreed to these Terms and Conditions.
24. Indemnification and Hold Harmless
To the fullest extent permitted by law, the customer agrees to defend, indemnify, and hold harmless PURO-TEC, its owners, officers, employees, agents, and subcontractors from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
(a) the customer’s use or reliance on the property condition checkup beyond its intended limited purpose;
(b) any third-party reliance on the property condition checkup, including but not limited to buyers, sellers, insurers, tenants, agents, contractors, or other persons;
(c) conditions at the property that were not visible, accessible, or reasonably discoverable at the time of service;
(d) any failure by the customer to follow recommendations for further evaluation, maintenance, or repair; or
(e) any use of the property condition checkup in connection with insurance claims, property transactions, or construction activities.
This indemnification obligation shall apply regardless of the theory of liability asserted and shall survive the completion of the service and any termination of the relationship between the parties.
